Strategic Considerations for Navigating the IRA Under the Trump Administration

Over the past 2 years, Covington's cross-disciplinary teams have advised dozens of pharmaceutical manufacturers, including most of the manufacturers of the first ten selected drugs, on the Inflation Reduction Act’s (IRA’s) drug pricing reforms. From this experience, we have gleaned insights on developing legal strategies across a manufacturer's asset portfolio: from pipeline products, to drugs seeking marketing authorization and drugs that may be selected into the Program in coming years. With the recent change in administration and the announcement of the next 15 drugs to enter the Program, there are outstanding questions about how the IRA’s health reforms may play out in the next year.
During this webinar, you will hear from a team of Covington lawyers led by Krista Carver and Rujul Desai—the co-chairs of the firm's IRA Task Force, as well as Kristie Gurley who is rejoining the firm after being a lead legal advisor at HHS Office of General Counsel on the overall implementation of the IRA. The presentation will discuss the evolving IRA landscape including initial signals from the new CMS leadership, insights from the recent selection of 15 additional drugs, and considerations regarding the future selection of Medicare Part B drugs and issuance of expected proposed regulations. This webinar will help manufacturers consider key internal strategy considerations to address a broad range of IRA legal, policy, and commercial strategic issues.
