California recently passed the nation’s first climate disclosure laws, with far-reaching effects for companies operating in the state. In a series of three bills, the State ushered in mandatory climate disclosures for public and private companies, ranging from Scope 1 to 3 greenhouse gas emissions, climate-related financial risk, and climate-related marketing claims, including those made by relying on carbon offsets.

In light of these new laws, as well as existing liability frameworks, companies face heightened scrutiny of their climate-related claims, emission reduction plans, and use of carbon offsets.
