Robert T. McMullen is a patent attorney who represents innovative companies in complex, multi-party litigations.
His focus is on Hatch-Waxman litigation as well as other life-science intellectual property disputes before U.S. district courts. Recently, in a pharmaceutical patent case, Robert served as trial counsel in a week-long jury trial followed by a two-day bench trial. He was involved in all aspects of these trials, including witness preparation, cross-examination preparation, and drafting motions on evidentiary disputes.
Robert has fostered his longstanding interest in patent law and intellectual property. After completing his B.S. in Chemical Engineering at the University of Maryland-College Park, he pursued his M.S.L., specializing in patent law. Before law school, Robert worked with laboratories at the University of Maryland-College Park to ensure regulatory compliance and helped professors take steps to protect their intellectual property for early-stage, innovative research. He received his J.D. from the University of Pennsylvania Law School, where he served as a Teaching Assistant for five intellectual property courses, including Patent Law and Introduction to Intellectual Property Law & Policy. He was even a Guest Lecturer for a class on trademarks and trade dress in his final semester. Robert also received his M.B.E. from the University of Pennsylvania Perelman School of Medicine and a Certificate in Management from the Wharton School at the University of Pennsylvania.
Robert’s pro bono practice focuses on veterans’ rights and queer rights. Currently, he represents a veteran in a discharge upgrade appeal and is part of a team supporting challenges to state-level bans on gender-affirming care for transgender individuals in multiple U.S. district courts, multiple U.S. appellate courts, and the U.S. Supreme Court.
From 2022 to 2023, Robert served as a judicial law clerk for the Honorable Raymond C. Clevenger, III of the United States Court of Appeals for the Federal Circuit.
